HEADLINE:  PROTECTING PROPERTY ZONING RIGHTS IN FOUNTAIN HILLS

WHAT: Summary of June 6 2023 Town Council Meeting

After continuing discussions in recent months about a request to rezone land at the SE corner of Palisades Blvd. & Mountainside Drive from single-family to multi-family, a presentation at this meeting by the law firm representing the developer, as well as multiple town residents expressing their opposition by public comment at this and prior meetings, with few voicing support for the request, the Council voted 5-2 to reject the petition to rezone.

WHY:  The area in question has been zoned R1-10 (single-family) and is adjacent to a parcel which is zoned R4 (multi-family).  The developer owns the R4 parcel and proposed to convert the R1-10 parcel to R4 zoning, allowing the development of four three-story buildings with 80 apartments.  The parcels are across Mountainside from an area of single-family homes.  Many residents expressed opposition to the proposed rezoning, explaining that it would violate the promise in place when they purchased their homes, and citing major traffic & safety concerns that the development would create.  While the developer delivered a detailed and well-designed plan, it was clear that the issue at hand was whether there existed a legitimate reason to rezone the property considering the overwhelming opposition of the current homeowners in the immediate vicinity.  The Council voted in support of the homeowners.
